The Spanish competition authority, Comisión Nacional de los Mercados y la Competencia (CNMC), has launched a formal investigation into Renfe Mercancías, Renfe-Operadora, and Pecovasa Renfe Mercancías for suspected anti-competitive practices in the railway traction services market.
The CNMC, responsible for ensuring fair competition and market efficiency in Spain, is scrutinizing a tender issued by Pecovasa on 20 January 2022. Renfe Mercancías, a state-owned trading company, secured the contract, prompting allegations of anti-competitive conduct.
The investigation seeks to determine if these practices breach Article 2 of the Law on the Defence of Competition (LDC) and Article 102 of the Treaty on the Functioning of the European Union (TFEU). The case began following a complaint from the Association of Private Railway Companies, leading to confidential inspections in October 2023.
Preliminary findings by the CNMC indicate that Renfe Operadora, Renfe Mercancías, and Pecovasa might have engaged in behavior that restricted market competition. However, the commencement of this procedure does not imply any conclusions about the final outcome. The CNMC has a 24-month period to conduct a thorough investigation and reach a decision.
This investigation underlines the regulatory focus on state-owned enterprises and their market activities within the European Union. The findings will be significant for the competitive dynamics of the railway sector in Spain and could have broader implications for similar markets across Europe.
